Consumer Forum

Large number of Indian Consumer’s are not aware or not have knowledge that Government has provided very effective tool to save them from producer’s, dealer’s, service provider’s false commitments ,schemes, installments, finances, guarantee, warrantee at the time of selling goods just to woo customer to purchase goods of their company only and this way successfully sell their items , especially in small villages and remote areas of India have not much information of Consumer forum despite Government efforts through publicities by both print and electronics media and once they purchased goods then at the time of problem face by consumer it left them directionless to proceed further in correct way for their right’s.
From consumer point of view whenever he buy anything or take service of any organisation or professional whether it’s government or private he must purchase it with bill and commitment of any scheme, installment or guarantee or warrantee should get in writing from dealer which will be evidence / proof if he deny anything he promise at the time of selling goods, and second if because of some reasons customer unable to get bill or lost bill or damage it then it’s not that for customer it’s end of road and can’t take action against dealer then any another customer who was present at the time of complainant purchasing his statement is acceptable but at the same time it’s not that Consumer forum is in favour of consumer and has not given any right to service provider, dealer or manufacturer to put his side ofcourse they are also protected and it’s one clause is so strong that if it’s found that consumer file a false case or guilty then consumer court can fine upto maximum ten thousand rupees to the customer also.
Anybody directly or through lawyer in any language can file case, its fees structure is if consumer has dispute amount –
Rs 1 to 5 Lakhs 200 Rs
Rs 5 to 10 Lakhs 400 Rs
Rs.10 to 20 Lakhs 500 Rs
Consumer forum has three level of justice which are divided at District ,State and National level on amount basis and complainant in writing can file his case as per his dispute amount –
District Consumer Forum upto 20 Lakhs – As name suggest District Consumer Forum has court’s in every District of India and with above coded fees he/she can file case and case can be filed without any lawyer if consumer think he can take his case itself.

State Commission upto 1 Crore – Every States Capital has Consumer Forum’s State Commission office and disputes upto one crore can be settle there.

National Commission above One Crore - In the capital of India National Commission has office whose address is below mentioned –
5th Floor, ‘A’ Wing, & 7th Floor, ‘B’ Wing, Janpath Bhavan, Janpath, New Delhi 110 001
and at National Commission office with below coded documents and fees consumer can file his case against service provider, manufacturer or dealer
Consumer Complaint (CC)
• Index
• List of Dates
• Memo of Parties
• Complaint with affidavit
• Limitation, if any (2 years from cause of action)
• Supporting documents in favour of complaint e.g. Receipt, voucher etc
• Fee for Rs.5,000/- for making Consumer Complaint (Demand Draft in the name of “The Registrar, NCDRC, New Delhi”)
Note:
• The documents shall be filed in English language only or translated copy of any other language.
• If the documents are not filed in order in the format mentioned above the same will be returned to the parties at the counter itself without acknowledgement and will only be registered after removing the defects.
• After admission hearing, any documents if filed in a case the same has to be served on the other side and be filed with proof of service, well in advance of two days earlier from the date of hearing.
• Henceforth, the review petition/application for recalling of order will be listed before the bench by way of circulation in chambers.
• No. of copies to be filed in the Commission 1+3 sets + Number of Opposite Parties. (with File cover)

So provided great facility for the right of consumer we as alert customer should get the benefit and it is our right also at the time of problem which generates because of false promises by service provider’s, manufacturer’s or service provider’s.
